Statutory Alert:Ballast Water Management Convention to enter into force on 8 September 2017

法規(guī)警示：壓載水管理公約將于2017年9月8日正式生效

Applicability: All shipowners and operators

The International Convention for the Control and Management of Ships’ Ballast Water and Sediments (the Ballast Water Management Convention) will enter into force on 8 September 2017. This follows the IMO confirming that the conditions for initiating entry into force were met on 8 September 2016.

《國際船舶壓載水和沉積物控制和管理公約》（壓載水公約）將于2017年9月8日正式生效。國際海事組織于2016年9月8日確認(rèn)啟動(dòng)公約生效的條件已滿足。

What does this meanfor you?

By 8 September 2017, all ships (i.e. vesselsof any type operating in the aquatic environment, including submersibles,floating craft, floating platforms, floating storage units (FSUs) and floating production, storage and offloading (FPSO) units) will be required to:

 截止到2017年9月8日，所有船舶（即在水生環(huán)境中營運(yùn)的所有類型的船舶，包括潛水器、浮船、浮動(dòng)平臺、浮動(dòng)儲(chǔ)存裝置(FSUs)和浮動(dòng)生產(chǎn)、儲(chǔ)存和卸載(FPSO) 裝置) 都應(yīng)滿足以下要求：

• have an approved ballast water management plan on board,

• 船上備有經(jīng)審批的壓載水管理計(jì)劃，

• maintain a ballast water record book, 

• 保留壓載水記錄薄

• manage their ballast water on every voyage by     performing ballast water exchange (or by treating it using an approved ballast water treatment system), and

• 在每個(gè)航次中，都通過壓載水交換（或使用經(jīng)認(rèn)可的壓載水處理系統(tǒng)）來管理其壓載水，以及

• undertake an initial survey and be issued with an     International Ballast Water Management Certificate (for ships of 400 gross tonnage and above to which the Convention applies, excluding floating     platforms, FSUs and FPSOs). Ships that are registered with flag administrations that are not yet a party to the Convention will need to demonstrate compliance and may wish to undergo surveys and be issued with a document of compliance.

• 進(jìn)行初次檢驗(yàn)，并獲得國際壓載水管理證書（公約適用的400總噸及以上的船舶，不包括浮動(dòng)平臺、浮動(dòng)儲(chǔ)存裝置和浮動(dòng)生產(chǎn)、儲(chǔ)存和卸載裝置）。若船舶所注冊的船旗國還不是公約的締約國，則船舶需證明其合規(guī)，可進(jìn)行檢驗(yàn)并簽發(fā)符合證明文件。

At alater date, ships will also be required to:

* Atreatment system is required to be fitted to vessels that carry out an IOPP renewal survey on or after 8 September 2017, and that have already passed their2017 delivery date anniversary. The IOPP renewal survey refers to the renewal surveyassociated with the IOPP Certificate required under MARPOL Annex I.

*2017年9月8日及以后進(jìn)行國際防止油污（IOPP）換證檢驗(yàn)的船舶和那些距其2017年交船日期已滿周年的船舶都要求安裝壓載水處理系統(tǒng)。國際防止油污（IOPP）換證檢驗(yàn)是指與MARPOL附則I 要求的國際防止油污（IOPP）證書相關(guān)的換證檢驗(yàn)。

Pleasenote that the Convention does not normally apply to:

• ships not carrying ballast water,

• domestic ships,

• ships that only operate in waters under the     jurisdiction of one party and on the high seas,

• warships, naval auxiliary or other ships owned or     operated by a state, or

• permanent ballast water in sealed tanks on ships, which is not subject to discharge.

Additionally,under certain circumstances, flag administrations may issue exemptions from the Convention requirements for:

• ships engaged on occasional or one-off voyages between specified ports or locations, or
